Description of the Office of the
District and County Attorney
Effective enforcement of the law requires the sure-handed expertise of a knowledgeable prosecutor.
The main duties of the county and/or district attorney is to represent the state in criminal cases. The county and/or district attorney works with law enforcement officers in the investigation and preparation of cases to be heard before the criminal courts. When requested in writing, the county attorney provides legal counsel to county officers.
The overwhelming importance of the office of public prosecutors arises from the fact that upon the prosecuting attorney rests the power of determining whether prosecution in any given case shall be inaugurated or, if inaugurated, pushed to a successful conclusion.
Other duties include prosecution of juvenile offenders, representation of victims of violence in protective orders and representing the Texas Department of Protective & Regulatory services in removing children from abusive households.
The county attorney is elected from each county in which there is no resident criminal district attorney. The county attorney serves a term of four years and the duties may coincide with those of the district attorney. In some counties, the county attorney is the chief prosecuting officer for the county courts.
The county attorney handles only criminal misdemeanor cases, as well as civil suits affecting the county, and other matters such as child support cases, revocation of probation, bond forfeitures, and commitment proceedings. The district attorney prosecutes felony cases in district court and represents state agencies, when requested to do so by the Attorney General's Office, in initiating court proceedings. However, this division of duties may vary; the district attorney may prosecute misdemeanor cases, and a county attorney may appear in district court.
The county attorney is the chief legal advisor to Chambers County and represents the county in suits affecting payment of taxes and eminent domain. The office generally handles all county requests for legal opinions from the Attorney General's Office.
