The Board of Directors of the FANNIN COUNTY PUBLIC FACILITY CORPORATION will hold a meeting on Thursday, September 16, 2021 at 9:00 a.m. in the Bonham City Hall, City Council Chambers, located at 514 Chestnut, Bonham, Texas.  The purpose of the meeting is for the consideration, discussion and possible action on the following agenda items:

Notice is hereby given that at this public meeting the business to be considered relating to Fannin County is solely for the purpose of conducting a Board of Directors meeting of the Fannin County Public Facility Corporation Board.  No business of the County will be discussed other than as it relates to the business of the Fannin County Public Facility Corporation.  No action on behalf of Fannin County will be taken at this meeting.  Notice is given that a quorum of the Commissioners Court may be present as Directors of the Public Facility Corporation and notice is given solely for the purpose of providing disclosure thereof.

OPEN MEETING:  Fannin County Detention Center in Fannin County; Discussion and action on the following matters concerning the Fannin County Detention Facility, including: Detention Services Agreement with U.S. Marshals Service; operation and management of the Facility; and other matters related to the Fannin County Detention Facility, including but not limited to the following:

1.                  Call to order;

2.                  Verification of quorum present;

3.         Review and approve minutes from previous meetings;

4.         EXECUTIVE SESSION:  Consultation with Attorney, a closed meeting will be held pursuant to Section 551.0725 for deliberation regarding contract negotiations where deliberation in an open meeting would have a detrimental effect on the Public Facility Corporation’s interests with a third party; and Section 551.071 of the Government Code regarding consultation with attorney to seek advice on pending and contemplated litigation, settlements, and other matters, which are confidential under the Disciplinary Rules of the State Bar, on which the duty of the attorney of the County under the Texas Disciplinary Rules of Professional Conduct clearly conflicts with the Open Meetings Act, regarding the financing and the operation of the Fannin County Detention Center and Operation and Management Agreement;

5.         Review, discuss and take action related to approval and/or ratification of Texas Commission on Jail Standards approval of revised plans and progress reports related to the Fannin County Detention Facility Expansion Project.

6.         Consider, discuss and take action regarding Operator payments to be made under existing Facility Operation & Management Agreements; reconciliation of obligations; approve, review and ratify payment requisitions; 

7.         Review, discuss and take action related to operation of Fannin County Detention Facility including any update on capital improvement requests for detention facility and requisition requests from Operating Reserve Repair Contingency Fund held by Trustee and authorize reimbursement and requisition to trustee for approved capital projects;

8.         Review, discuss and take action to ratify the engagement of Acker & Company to perform the audit for the year ended September 30, 2021;

9.         Review, discuss and take action to authorize reimbursement and payment of professional fees related to operation and maintenance of the Fannin County Detention Facility; (a) auditor and accounting fees and/or (b) legal fees;

10.       Consider approval of recurring requisitions form for reimbursement of operation and management costs to LaSalle Corrections and authorize Judge Randy Moore as president of and on behalf of Fannin County PFC to execute monthly resolutions and submit payment on the 10th of each month for regularly recurring invoices for previously approved contracts and obligations under the Operation and Management Agreement due and/or received prior to next called meeting;
