EXECUTIVE SESSION(S) AND ACTION IF NEEDED:

37. Pursuant to Texas Government Code, Section 551.071, Commissioners Court reserves the right to
meet in Executive Session to consult with their attorney (BESS lawsuit settlement discussion) – County Judge

38. Pursuant to Texas Government Code, Section 551.0725 for deliberation regarding contract
negotiations where deliberation in an open meeting would have a detrimental effect on the County’s
interests with a third party (Public Facilities Corporation) – County Judge

39. Pursuant to Texas Government Code, Section 551.074, Commissioners Court reserves the right to
meet in Executive Session to discuss personnel issues – County Judge

40. Discussion and action on the following matters concerning the Fannin County Detention Facility, related to Amended and Restated Facility Operation & Management Agreement; and Consider, discuss and take action to approve amendments to Operating and Management Agreement related to funding of Operator Reserve Repair and Contingency Account (ORRC) to fund capital expenditures and incorporation of Modification No. 13, Intergovernmental Agreement between the U.S. Marshals Service and Fannin County to increase the per diem rate effective for 36 months and necessary amendments to Trust Indenture – County Judge for Herb Bristow
